Terms & Conditions

These are the terms & conditions of the company Atelier PROMIKA, with its registered office at Muchova 9/223, 160 00 Prague 6, the Czech Republic (this address is also the delivery address), identification number 26080273, tax identity number: CZ26080273 ("Atelier PROMIKA") by which relationships between Atelier PROMIKA and its clients (the "Client") in relation to delivery of goods created and modified according to the Client's requirements under the conditions set out below (the "Terms & Conditions").

1.    SUBJECT MATTER

1.1.    Atelier PROMIKA shall deliver goods offered on the website www.kazoostory.cz to the Client which will be created and modified according the Client's requirements (the "Goods").

1.2.    The Client shall pay sales prices of the Goods together with the transportation costs (as defined in paragraph 4.3 below) in the amount and under the following conditions.

2.    AGREEMENT

2.1.    Subject to the exception set out in paragraph 3.2 below the order sent by the Client to Atelier PROMIKA through internet application of Atelier PROMIKA or by e-mail of Atelier PROMIKA is considered to be a proposal for conclusion of a contract on delivery of Goods (the "Order").

2.2.    Orders made and delivered to Atelier PROMIKA according to paragraph 2.1 above are binding for the Client.

2.3.    Contract on delivery of Goods is concluded when the Client receives an e-mail confirmation from Atelier PROMIKA (the "Order Confirmation").

2.4.    The Client declares that he/she is aware that Atelier PROMIKA is not obliged to accept the Order, send the Order Confirmation or to inform the Client that it will not fulfil the Order.

2.5.    The Order expires by:

(a)    sending an announcement from Atelier PROMIKA to the Client that his/hers Order was rejected; or

(b)    expiry of a thirty days period if the Client does not receive the Order Confirmation within such period from Atelier PROMIKA.

3.    PRICE

3.1.    Prices of the Goods on the Atelier PROMIKA's website are stated including VAT (the "Price"). The Seller is a VAT payer.

3.2.    The Seller has a right to change the Price of all Goods or the transportation costs (as defined in paragraph 4.3 below). New Price or the changed transportation costs will be applied on all Orders that were not delivered to Atelier PROMIKA by the time of announcement of the change (see bellow). In case of the change of the transportation costs the Client will be informed in a written form and will be asked to resend his/hers Order together with an acceptance of this change. Order sent to Atelier PROMIKA in accordance with the previous sentence will be considered an Order under these Terms & Conditions.

3.3.    The Price includes all costs, fees and taxes except for the transportation costs. The Client will not be charged any fees for long distance communication.

4.    PAYMENT TERMS

4.1.    The purchase price of the Goods supplied to the Client shall be calculated as a total of all ordered Goods and relevant Prices (the "Purchase price"). The exact amount of the Purchase price specified in accordance with these Terms & Conditions must always be stated in the Order.

4.2.    The Purchase price can be paid by following means as chosen by the Client in the Order:

(a)    by a bank wire transfer before the delivery of the ordered Goods; or

(b)    by cash on delivery.

4.3.    The Client shall pay the transportation costs as specified in the last step of the order form on the Atelier PROMIKA's website.

5.    DELIVERY TERMS

5.1.    Expected delivery time is two weeks. Exact delivery period will be specified in the Order Confirmation by Atelier PROMIKA.

5.2.    The Goods will be delivered to the Client's address stated in the Order by a transportation company chosen by Atelier PROMIKA.

5.3.    The transportation costs will be set out with regard to the chosen mean of delivery and under the conditions set out on the Atelier PROMIKA's website.

5.4.    The Client shall confirm receipt of the Goods on a delivery bill. By signing this receipt the Client confirms that:

(a)    he/she has received the Goods according to the Order; and

(b)    the Goods have not been damaged during the shipping.

6.    WARRANTY

6.1.    Atelier PROMIKA provides a warranty in relation to the Goods in accordance with Czech law.

6.2.    The Client is obliged to follow instructions for use of the Goods set out by Atelier PROMIKA and stated on the Atelier PROMIKA's website and also delivered to the Client together with the Goods (the "Instructions"). If any defect appears on the Goods caused by violating of this obligation by the Client especially if the Goods were damaged by incompetent handling or were not used according to the Instructions, the Client cannot require a compensation from Atelier PROMIKA.

6.3.    If the Client finds a defect on Goods he/she is obliged to notify Atelier PROMIKA about such defect without undue delay, however within thirty days at the latest.

7.    WITHDRAWAL FROM THE AGREEMENT

The Client declares that he/she is aware of the fact that the Goods are made and modified according to his/hers requirements and therefore he cannot withdraw from the agreement with Atelier PROMIKA according to the Section 53(8)(c) of the Act number 40/1964 Coll., the Civil Code, as amended (the "Civil Code").

8.    PERSONAL DATA PROTECTION AND BUSINESS CORRESPONDENCE

8.1.    Atelier PROMIKA processes personal data of the Client stated in the Order and necessary for making, modifying and transportation of the Goods and also for the purpose of sending special offers or information from Atelier PROMIKA to the Client (provided that the Client has agreed to receive such correspondence in his Order and hasn't cancelled such agreement by an email sent to Atelier PROMIKA).

8.2.    Atelier PROMIKA will not give the personal data of the Client to any third person or publish them in any other way.

8.3.    The Client agrees with the above mentioned way of processing his/hers personal data by Atelier PROMIKA. The Client’s consent with processing of his/hers personal data is granted for a period of five yeas. The Client has a right to cancel his consent in accordance with the Act number 101/2000 Coll., on Personal Data Protection, as amended.

9.    FINAL PROVISIONS

9.1.    The Order shall be deemed as delivered on the date of its sending in case of Orders delivered through the internet application of Atelier PROMIKA.

9.2.    Agreement between the Client and Atelier PROMIKA and any rights or obligations resulting from it shall be governed by Czech law, particularly by the Civil Code.

9.3.    Atelier PROMIKA has a right to change these Terms & Conditions (the "New Terms & Conditions"). The New Terms & Conditions will be applied in relation to all Orders that were not delivered to Atelier PROMIKA by the time of such change (e.g. by the time of its publishing on the Atelier PROMIKA’s website).

9.4.    The Client agrees with these Terms & Conditions by sending the Order to the Seller.
